Article 1: Description and Acceptance of General Terms and Conditions

These general terms and conditions of sale are intended, on the one hand, to inform any potential consumer about the conditions and methods by which the seller proceeds with the sale and delivery of the ordered products, and on the other hand, to define the rights and obligations of the parties in the context of the sale of products by the seller to the consumer. They apply, without restriction or reservation, to all sales by SARL NEWS PARFUMS of the products offered on its website.

All orders placed through the Site, as well as all related services, are subject without reservation to these General Terms and Conditions. These General Terms and Conditions represent the entirety of the mutual commitments between the Company and the Client, who expressly accepts them. SARL NEWS PARFUMS reserves the right to modify these General Terms and Conditions of Sale at any time. The changes made will be applicable upon their publication on the News-Parfums.com website.

Prior to placing an order, the Buyer declares that:

The purchase of products on the SARL NEWS PARFUMS website is unrelated to their professional activity and is limited to strictly personal use;

They have full legal capacity, allowing them to engage under these general terms and conditions of sale.

Article 2: Definitions of the Seller

SARL NEWS PARFUMS, hereinafter referred to as "the Company," is a limited liability company with a capital of 60,000 Euros, having its registered office at 5 Rue du Jeune Anarcharsis, 13001 Marseille, registered with the Marseille Trade and Companies Register under number 348 559 634, and its online website http://www.news-parfums.com.

The Company conducts online sales of perfumery, cosmetics, beauty products, and accessories to individuals.

The e-commerce site www.news-parfums.com provides users with free information (excluding telephone connection costs and fixed-line phone calls to the company) on products manufactured by various referenced manufacturers in the online catalog, as well as a system for placing orders and making payments online, subject to the customer's compliance with these general terms and conditions. SARL NEWS PARFUMS reserves the right to modify these general terms and conditions of sale at any time.

Article 3: Products Sold on the Site

News-Parfums.com is an online sales site for perfumes, makeup products, and cosmetic care. The Company sources Products from manufacturers who have expressly agreed to be listed in the Site's Product Catalog. The essential characteristics (qualitative and quantitative) of the Products obtained directly from the manufacturers are described in the Product Sheets.

The Company expressly reserves the right at any time to add new Products, delete all or part of the Products sold or presented in the Site's Catalog, change their presentation, or cease their commercialization on its Site, without being required to notify the Client in advance.

Article 4: Information and Limitations of Liability

While taking the utmost care in posting information and data available for free on the Site and keeping it up to date, SARL NEWS PARFUMS cannot be held responsible for inaccuracies, errors, or omissions that may have inadvertently slipped into the product descriptions provided by the manufacturers.

SARL NEWS PARFUMS cannot be held responsible for typographical errors on the Site that are beyond its control. Similarly, the photographs and graphics in the Site's Catalog, which illustrate the Products to support the text, are indicative and do not enter into the contractual scope. Therefore, they do not engage SARL NEWS PARFUMS, which cannot be held responsible for any inaccuracies or errors that may be introduced.

More generally, SARL NEWS PARFUMS cannot be held responsible for:

  • Interruptions or delays recorded on the Site due to maintenance work, technical failures, a force majeure event, third-party actions, or any other circumstances beyond its control;
  • Temporary inability to access the Site due to reasons beyond its control, such as Internet network interruptions or client reception equipment failures to the Internet network;
  • Any bugs;
  • Any damage resulting from a fraudulent intrusion by a third party that led to a modification of the information available on the site;
  • And more generally, for any direct or indirect damage, regardless of the causes, origins, nature, or consequences, including but not limited to the costs that may arise from acquiring goods offered on the site, loss of profits, clientele, data, or any other loss of intangible property that may occur due to anyone's access to the site or inability to access it, or the credit given to any information coming directly or indirectly from it.

The offers available on the site regarding gifts offered with an order are not contractual but at the discretion of SARL NEWS PARFUMS and subject to stock availability. These gifts and their photos are not contractual. SARL NEWS PARFUMS cannot be held responsible for the absence or replacement of a gift in an order.

In accordance with Article L. 152-1 of the Consumer Code, you can use the MEDICYS mediation service free of charge via their website or by post: Concord - 73, Boulevard de Clichy - 75009 Paris.

Any dispute relating to the interpretation, performance, or termination of the contract between the Company and the Client, even in the event of a warranty claim or multiple defendants, will, in the absence of an amicable agreement, fall under the exclusive jurisdiction of the French courts. Relations between the Company and the Client are subject to French law.

Article 5: Orders

Any order implies full acceptance without reservation of these general terms and conditions of sale. Placing an order on the Site is subject to strict compliance with a procedure and is materialized online by a succession of different steps indicating the various phases that the Client must follow to have their order validated by the Company.

Orders are placed online according to the website's order form (Add to Cart). The Client agrees that the information provided to the Company is complete, accurate, and up-to-date.

In case of incomplete or inaccurate information, SARL NEWS PARFUMS reserves the right to cancel the order and payment without further notice.

In accordance with the Data Protection Act of January 6, 1978, the Client has the right to access, modify, rectify, and delete personal data concerning them. To exercise this right, they simply need to send an email to: service@news-parfums.com or write to SARL NEWS PARFUMS.

As a general rule, it is expressly agreed between the Company and the Client that emails will be valid between the parties, as will the automatic recording systems used on the Site, particularly regarding the nature and date of the order.

The sale will only be considered final after SARL NEWS PARFUMS sends the buyer the order confirmation and receives full payment.

SARL NEWS PARFUMS recommends that the buyer keep this information on paper or electronic document.

Article 6: Prices

The prices indicated in the Product Catalog accessible on the Site are indicative, updated daily, and therefore subject to change without notice. However, the prices charged are those in effect on the date of the order. The Client may also benefit, during certain specified periods, from promotional offers on certain Products. These offers will be announced online on the site and will be valid during the indicated period and always subject to stock availability. The prices indicated are all taxes included. Any shipping costs are charged in addition.

Article 7: Billing

An invoice is issued for each delivery and sent by SARL NEWS PARFUMS by mail or email to the Client at the billing address provided by the Client when placing the order. Any complaint regarding invoices must be brought to the Company's attention by email within 7 days of receipt at service@news-parfums.com. Otherwise, they are considered accepted without reservation. The possible incomplete delivery of an order does not justify the refusal to pay for the delivered Products. Any dispute between the Client and SARL NEWS PARFUMS is in no way a reason for suspending payment of the undisputed part of the invoice.

Article 8: Payments

1/ Payment by Check via Mail

Payment at the time of order is required by SARL NEWS PARFUMS, and delivery will only be made upon receipt and clearance of the Client's check.

After receiving an order confirmation by email, the client must send their payment by check made out to SARL NEWS PARFUMS, for the amount indicated on the order and confirmation, to the following address: 5 Rue du Jeune Anarcharsis, 13001 Marseille, accompanied by a copy of the order form.

2/ Secure Online Payment by Credit Card

Online payment benefits from the secure online payment system SSL of the BNP Paribas ATOS server. The Client accesses a secure server operating in SSL mode (128 bits) and certified by BNP Paribas.

The Client must provide their bank details by filling out the online form, and the transaction is carried out according to banking security standards. Thanks to the technical features of the encryption software used on the Site, the bank details (credit card number, expiration date, and cryptogram) provided by the Client cannot be intercepted by a third party. Therefore, none of this information transits or is stored on the Internet.

By providing their bank details, the Client accepts in advance and without condition that BNP Paribas will proceed with the secure transaction. The Client therefore authorizes their bank in advance to debit their account based on the records or statements transmitted by BNP Paribas' central credit card system (ATOS) on behalf of SARL NEWS PARFUMS.

3/ Payment by Bank Transfer

Payment at the time of order is required by SARL NEWS PARFUMS, and delivery will only be made upon receipt of full payment for the order in SARL NEWS PARFUMS's bank account.

4/ Payment by PayPal

By selecting payment via PayPal on our site, you accept without reservation PayPal's terms of use.

Article 9: Deliveries, Delivery Methods

The client is required to provide a valid address corresponding to their home, a relative's home, their workplace, or a personal P.O. box. No claim will be accepted if the provided address is incomplete or incorrect.

If a package is returned by the carrier to News Parfums because the address provided by the Client was incomplete or incorrect, the client will have the choice between repaying the delivery costs for resending at the usual rate of our site, being refunded for their order minus the shipping costs, or being fully refunded in the form of a voucher.

The products will be delivered to the address indicated by the Buyer on the order form. By default, invoices are sent to the email address provided by the Client during registration. Failure to follow the procedures outlined below will result in no acceptance of the Buyer's claim.

Delivery Service Characteristics

The client is delivered to their home or a relay point by the carrier chosen at the time of the order, either in the mailbox (Colissimo without signature) or in person (Colissimo with signature), or in a partner merchant relay point and signs a distribution receipt for home services with signature and in relay points. In case of absence, the Buyer or the recipient of the ordered product receives a delivery notice, allowing them to collect the ordered products from the nearest post office within a specified period.

The client is required to check the condition of the packaging and the contents of the goods upon delivery in the presence of the post office worker, the delivery person, or the partner merchant.

In the event that the client has any doubts about the condition or contents of their package, they must:

  • Apply the carrier's procedure (notably reporting damage, making all claims and reservations) and refuse the goods by immediately issuing an anomaly report to the carrier's representative.
  • Report these incidents to SARL NEWS PARFUMS within 24 hours.

A delay in delivery cannot, under any circumstances, justify the cancellation of ongoing orders, and no compensation or penalty for delayed delivery, regardless of the causes, significance, and direct or indirect consequences, can be claimed. Specifically, SARL NEWS PARFUMS cannot be held responsible for delivery delays attributable to the carrier or due to any other force majeure event. Events such as lock-out, strikes, manufacturing delays at the manufacturer, war, riot, fire, flood, water damage, storm, lightning, requisition, decisions by any authority, inability to be supplied, shortage or delay in the transport of Products, or generally any event beyond the control of SARL NEWS PARFUMS are considered force majeure events that discharge SARL NEWS PARFUMS from its obligation to deliver and more generally from all responsibility.

SARL NEWS PARFUMS will inform the Client within a reasonable time of any force majeure events likely to disrupt the delivery process of the ordered Product. However, if 15 days after the indicative delivery date the order has not yet been shipped, the Client may request the return of the amounts paid for the order, excluding any other compensation or damages, by sending a written request via registered mail with acknowledgment of receipt. The Client may also accept a new delivery date without being able to demand a price reduction or damages. In any case, timely delivery can only occur if the Client is up to date with their obligations to the Company, regardless of the cause.

If a package has been shipped but the Client has not received any news of their order 5 business days after the shipment date in France and 15 business days abroad, they must notify News Parfums' Customer Service via email within a maximum of 30 days from the shipment date and contact the carrier by phone or email.

If the carrier indicates that they have traced the package, the Client must notify News-Parfums.com within 7 business days by email in the "Contact > After-Sales Service" section to file a claim.

News Parfums' Customer Service will then open an investigation with the carrier's services. The Client will receive an email indicating that an investigation has been opened. The response times from the carrier vary, and News Parfums' response time depends on this.

  • If the package is found, it is sent to the Client: the receipt procedure then follows its normal course (package deposit or delivery notice, etc.).
  • If the package is declared lost, and if the Client chose an insured shipping service for the said order, News-Parfums.com will immediately proceed with the replacement or credit note for the order corresponding to the lost package (products and shipping costs).

If a package without a signature is marked as delivered on the carrier's tracking page but the Client has not received it and makes a claim, SARL News Parfums cannot be held responsible as the client was informed at the time of choosing the carriers that the no-signature service does not include insurance against loss and theft, unlike other Colissimo delivery services available on our site.

In case of exceeding the stated deadlines, the sale is considered concluded, and SARL NEWS PARFUMS cannot be held responsible for the non-receipt of the order.

If a package is made available to a client by a service provider and not collected within the withdrawal period, the order will be refunded. In this case, the initial actual shipping costs already charged by the carrier, if they exceed €10 excluding VAT, will be deducted from this refund, or the announced price on the site when the actual shipping costs charged by the carrier are less than €10 excluding VAT, or if the delivery was free, a flat fee of €6.50 including VAT for home delivery and €4.50 including VAT for standard relay point delivery (non-express) will be deducted.

Article 10: Receipt of Products

Upon receiving the Product, the Client must immediately check the conformity and integrity of the shipped products. Generally, any reservations or observations must be precisely noted on the delivery note, specifying the damage, the order number, and so on.

Moreover, slightly damaged packaging does not entitle the Client to request compensation or free return. In case of returning the order, all elements of the order (samples, gifts) must be returned, under penalty of a flat-rate deduction of up to €10 including VAT from the order refund.

- For packages delivered in person, the Client must refuse the package if they suspect any deterioration (stained package or strong perfume smell). In this specific case, upon receipt of the return in our offices, a new package will be sent with the same carrier as the original one, or a voucher for the order amount will be communicated to the Client. The delivery of any package whose tracking is noted as delivered, and whose delivery note is signed, cannot be contested.

- For packages delivered in the mailbox or received in person without verifying the integrity of the package and products, the Client must contact News-Parfums.com's After-Sales Service by email within 3 days of receiving the package and provide all requested material and digital evidence. Failure to produce or upon the decision of the said service, a compensation request may be wholly or partially refused by a simple email. In all cases, no refund will be issued. Only a package reshipment or a voucher will be made if the Client's provided documents are previously validated by Customer Service. In all cases of non-delivery compensation claims, a copy of the report to the competent authorities must be provided to open a non-receipt file.

IMPORTANT: Taxation for Non-EU and DOM TOM Clients

You pay excluding taxes on our site. Customs clearance fees, taxes, and maritime import duties may be requested upon delivery. In Réunion, Martinique, and Guadeloupe, this taxation has been systematically applied since early 2022. It is approximately 25% of the package amount. Considering the discounts we apply on our site, you are still largely benefitting.

If you refuse the package upon arrival, the actual delivery and return costs of the package will be charged to you, ranging from €30 to €100 depending on the weight of the package.

 

Article 11: Product Returns

In case of a technical anomaly of the Product or an error in the delivered reference, the Client will follow the product return procedure described below. The costs and risks of return are always the Client's responsibility unless there is a manifest error in the received reference. Only a voucher for the value of the current Colissimo package in Metropolitan France or the current package value in the client's delivery country will be issued by News Parfums if the delivered products do not match the ordered references.

Technical anomalies must be reported to SARL NEWS PARFUMS by email within 3 days following the delivery date, stating the Client's references, the invoice number and date, the Product reference, the quantity, and the exact reason for the request.

Errors in the received product reference must be reported to SARL NEWS PARFUMS by email within 30 days following the delivery date, stating the Client's references, the invoice number and date, the Product reference, the quantity, and the exact reason for the request.

The products must be returned complete, in simple Colissimo shipment or equivalent economic shipment without option or signature, in perfect condition, and in their original packaging placed in a blank carton, taking care not to place any writing or tape on the original packaging. SARL NEWS PARFUMS reserves the right to refuse any return not complying with the conditions mentioned above. No credit can be issued upon receipt of a damaged or opened product unless this condition has been confirmed on the Return form after agreement from SARL NEWS PARFUMS.

All elements of the order (samples, gifts) must be returned with the return, under penalty of a flat-rate deduction of up to €10 including VAT from the order refund.

Article 12: Renunciation

The Product(s) ordered by the Client are contractually deliverable within 7 working days for Clients residing in Metropolitan France and 14 working days for all other destinations. If the Order is not delivered within 7 days following the expected delivery date, the Client may exercise their right of renunciation within 60 days from the expected delivery date by mail or email.

Any return accepted by SARL NEWS PARFUMS, after verification of the returned products, will result, at the Client's choice, in the creation of a credit note, free replacement, or refund of the Order. Return costs are the Client's responsibility.

In case of renunciation, the returned order or products are subject to the return conditions stated in Article 11 of these GTC.

Article 13: Withdrawal

The Client may exercise their right of withdrawal by mail or email before their Order is shipped, or within 30 days following receipt. Any product return must first be validated by Customer Service. Products must be returned complete in simple Colissimo shipment or equivalent economic shipment without option or signature, in perfect condition, and in their original packaging placed in a blank carton, taking care not to place any writing or tape on the original packaging. SARL NEWS PARFUMS reserves the right to refuse any return not complying with the conditions mentioned above. No credit can be issued upon receipt of a damaged or opened product unless this condition has been confirmed on the Return form after agreement from SARL NEWS PARFUMS.

Any return accepted by SARL NEWS PARFUMS, after verification of the returned products, will result, at the Client's choice, in the creation of a credit note, free replacement, or refund of the Order. Return costs are the Client's responsibility.

Article 14: Refund Periods

In case of a refund following a dispute, withdrawal, or renunciation, we commit to refunding the agreed amount with our customer service without undue delay and no later than fourteen days from the day you have agreed in writing to this refund with our customer service. In case of a refund in exchange for merchandise return, we may defer the refund until we have received the merchandise or until you have provided proof of shipping the merchandise back, the retained date being that of the first of these facts. For refunds by credit card, note that interbank delays may postpone the actual credit to your account by a few days.

Article 15: Product Warranty

If the Company's liability should be held due to the non-performance or poor performance of its services, the total indemnities cannot, by express agreement, exceed an amount equal to the price of the Product that caused the damage.

In addition to the legal warranty against hidden defects resulting from Articles 1641 to 1649 of the Civil Code, for which the client must notify SARL NEWS PARFUMS of the existence of such a defect by registered mail with acknowledgment of receipt within a short period, the Products sold by SARL NEWS PARFUMS benefit from the manufacturer's warranty. The warranty granted by the manufacturer is only binding on the manufacturer.

SARL NEWS PARFUMS provides a customer service to respond to all questions and comments the client may have while using the site.
